Work Permit for Foreign Teachers: Conditions, Documents & Procedures

 

In order for foreign teachers to work in Vietnam, one of the mandatory procedures is to apply for a Work Permit for Foreign Teachers. Conditions for Obtaining Work Permits for Foreign Teachers

To apply for a Work Permit for foreign teachers, the following conditions must be met:

  • Foreign teachers must be at least 18 years old and have full civil capacity.
  • The visa of the foreign teacher in Vietnam must be valid during the period of applying for the Work Permit.
  • Foreign teachers must be in good health and have a health check certificate as regulated by the Ministry of Health.
  • They must be invited and sponsored by an educational institution, language center, or national university in Vietnam for work and residence according to legal regulations.
  • They must have a clean background both abroad and in Vietnam if they have previously taught at educational institutions, language centers, or universities.
  • They must not be serving a sentence, have not had their judicial record expunged, or be under criminal investigation according to the laws of their home country or Vietnamese law.
  • They must hold at least a bachelor’s degree or equivalent and have a minimum of 3 years of relevant work experience in the teaching position they are expected to fill in Vietnam.

Procedures for Obtaining a Work Permit for Foreign Teachers

Step 1: Prepare and submit a request for approval of the need to employ foreign teachers to the Department of Labor, Invalids and Social Affairs. The report explaining the need to employ foreign teachers must be submitted at least 30 days prior to the intended start date of the foreign teachers. The Department of Labor, Invalids and Social Affairs will provide a written approval or disapproval within 10 working days from the date of receiving the explanation.

Step 2: Prepare and submit the application for a Work Permit for foreign teachers to the Department of Labor, Invalids and Social Affairs. The application for a Work Permit must be submitted at least 15 days before the foreign teacher’s planned start date in Vietnam. The Department of Labor, Invalids and Social Affairs will issue the work permit for the foreign teacher within 5 working days from the date of receiving a complete application as per regulations.

Documents for Obtaining a Work Permit for Foreign Teachers

Step 1: Prepare and submit the application for approval of the need to employ foreign teachers to the Department of Labor, Invalids and Social Affairs.

✔️ Legal documents of the company (Business Registration Certificate, Investment Registration Certificate, and other operational licenses if available);

✔️ Application form explaining the need to employ foreign teachers. Form No. 01/PLI or Form No. 02/PLI issued under Decree 152/ND-CP. Form No. 01/PLI is used when there is no position available and seeks approval for the need to employ foreign teachers. Form No. 02/PLI is used when the need to employ foreign teachers has already been registered and needs adjustment;

✔️ Letter of introduction for the employee/Power of attorney for the representative to carry out the procedures.

Step 2: Prepare and submit the application for a Work Permit for foreign teachers to the Department of Labor, Invalids and Social Affairs.

✔️ Document requesting the issuance of a Work Permit for foreign teachers;

✔️ Document approving the need to employ foreign teachers issued by the Department of Labor, Invalids and Social Affairs (result obtained in Step 1);

✔️ Notarized copy of the Business Registration Certificate of the enterprise/organization/agency employing the foreign teacher;

✔️ Notarized and translated copy of all pages of the passport valid for more than 6 months;

✔️ The foreign teacher must have a health check certificate from one of the following two types:

  • The health check-up certificate issued abroad with a validity of 6 months or 12 months must be consular legalized (as regulated in certain provinces);
  • The health check-up certificate issued in Vietnam must be obtained from hospitals designated by Vietnam within 12 months.

✔️ Judicial record No. 01 issued within the last 06 months / Document confirming that the foreign teacher is not currently serving a sentence or has not had their criminal record cleared or is under criminal investigation, issued within the last 06 months (if it is a document from a foreign organization, it must be consular legalized and accompanied by a notarized translation):

  • Foreign judicial record: Issued by a competent authority in the host country and must be consular legalized;
  • Judicial record issued by the Department of Justice in the province/city in Vietnam.

✔️ Academic certificates (Intermediate/College/University/Master’s/Doctorate, etc.) or foreign language certificates that have been translated and notarized;

✔️ Documents confirming that the foreign teacher has 03 years or 05 years of work experience in the host country for the teaching position in Vietnam;

✔️ Certificates and documents related to pedagogical qualifications and teaching proficiency. If the foreigner does not possess academic degrees, they must provide a teaching competency certificate suitable for the job position;

✔️ A 4×6 cm ID photo , with a white background, taken within the last 6 months.
