What is a Work Permit for Chinese?

A Work Permit for Chinese, is a document that indicates the permission of a country for Chinese individuals to work within its territory. The work permit is important and necessary because a visa only allows Chinese individuals to enter another country, not to work there. Therefore, if Chinese workers wish to work in Vietnam, they need to obtain a work permit to comply with current laws.

Conditions for Applying for a Work Permit for Chinese 

To obtain a work permit for Chinese in Vietnam, the following conditions must be met according to Decree 152/2020/ND-CP dated December 30, 2020, regulating foreign workers in Vietnam and the recruitment and management of Vietnamese workers employed by foreign organizations and individuals in Vietnam:

  • Chinese nationals working in Vietnam must have health suitable for the job requirements.
  • Chinese nationals working in Vietnam must have full legal capacity according to Vietnamese law.
  • Chinese nationals working in Vietnam must not have committed a crime or be subject to criminal prosecution under Vietnamese law and foreign law.
  • Chinese nationals working in Vietnam must be employed in specific positions such as: manager, executive director, expert, or skilled worker.
  • Chinese nationals working in Vietnam must have written approval from the competent state authority regarding the employment of foreign workers.

Documents for Applying for a Work Permit for Chinese 

Step 1: Prepare and submit the application for approval of the need to employ Chinese workers to the Department of Labor, Invalids and Social Affairs.

  1. Legal documents of the enterprise (Business registration certificate, Investment registration certificate, and other operating licenses if any);
  2. Application form explaining the need to employ labor. Form No. 01/PLI or Form No. 02/PLI issued under Decree 152/ND-CP. Form No. 01/PLI is for new positions and requests approval for the need to employ Chinese workers. Form No. 02/PLI is used in cases where the need to employ Chinese workers has been registered and needs adjustment;
  3. Introduction letter for the employee/Authorization letter for the representative to carry out the procedure.

Step 2: Prepare and submit the application for a Work Permit for Chinese workers to the Department of Labor, Invalids and Social Affairs.

  1. Document requesting the issuance of a work permit for Chinese workers;
  2. Document approving the need to employ Chinese workers issued by the Department of Labor, Invalids and Social Affairs (result obtained in Step 1);
  3. Notarized copy of the business establishment certificate of the agency/organization employing Chinese workers;
  4. Notarized copy, translated of all pages of the valid passport of the Chinese worker, with at least 6 months remaining before expiration;
  5. Chinese workers must have a health certificate from one of two types:
  • Health certificate issued in China valid for 6 months or 12 months must be consular legalized (as required in some provinces);
  • Health certificate issued in Vietnam, for foreigners, must be issued by hospitals designated by Vietnam within 12 months.
  1. Judicial record number 1 issued within the last 6 months/Document confirming that the Chinese worker is not currently serving a sentence or has not had a criminal record erased, or is not under criminal investigation issued within the last 6 months. If it is a document from the competent authority in China, it must be consular legalized with a notarized translation or issued by the Department of Justice of the province/city under central authority in Vietnam;
  2. Relevant qualifications (diploma from Intermediate/College/University/Master’s/Doctorate corresponding to the expertise, job requirements of the employer) and Certificate of work experience in the profession or in production management (issued or certified by a foreign agency/organization);
  3. ID photo size 4x6cm, white background, taken within the last 6 months.

Procedure for Applying for a Work Permit for Chinese 

Step 1: Prepare and submit the application for approval of the need to employ Chinese workers to the Department of Labor, Invalids and Social Affairs. The report explaining the need to employ foreign labor must be submitted at least 30 days before the intended use of Chinese workers. The Department of Labor, Invalids and Social Affairs will provide a written approval/disapproval within 10 working days from the date of receipt of the application.

Step 2: Prepare and submit the application for a Work Permit for Chinese workers to the Department of Labor, Invalids and Social Affairs. The application for the work permit for Chinese workers must be submitted at least 15 days before the date the Chinese worker is expected to start working in Vietnam. The Department of Labor, Invalids and Social Affairs will issue the work permit within 5 working days from the date of receiving a complete and valid application.
