A foreign-invested company operating in the construction sector in Vietnam is an individual or organization of a country investing capital to conduct business activities in the construction sector through investment forms according to the provisions of investment law in Vietnam to invest in Vietnam for the purpose of doing business and seeking profits.

Human resource conditions for foreign-invested construction companies in Vietnam

For a title, the following individuals practicing construction activities must have a practice certificate according to regulations, including: project management director, individuals directly involved in project management; construction planning design manager; construction survey manager; design manager, construction design reviewer; construction site commander; construction supervision; construction inspection; construction valuation

Current practice certificates are divided into class I, class II, class III.

 

So who is granted a practice certificate? What are the current conditions for granting a practice certificate for each level?

Individuals are granted a practice certificate in Vietnam when they meet the following basic conditions:

– Have full civil act capacity according to the provisions of law; have documents on residence or work permit in Vietnam for foreigners and Vietnamese people residing abroad.

– Have professional training, time and work experience suitable for the content of the request for a basic practice certificate as follows:

+ Grade 1 construction practice certificate: Have a university degree in a suitable major, have work experience suitable for the content of the request for a practice certificate of 07 years or more;

+ Grade 2 construction practice certificate: Having a university degree in a relevant major, having at least 04 years of work experience in accordance with the content of the application for a practice certificate; 

+ Grade 3 construction practice certificate: Having at least 02 years of work experience in accordance with the content of the application for a practice certificate for individuals with a university degree; from 03 years or more for individuals with a college or intermediate degree.

 

Conditions for foreign employees working at foreign-invested construction companies in Vietnam

Currently, the Labor Code still limits only 4 job positions that foreigners are allowed to work in Vietnam. Specifically, the positions that foreign workers can be licensed to work in Vietnam are as follows:

– Manager: To prove that a foreign worker is a manager, the foreign worker needs to provide the following documents:

+ In case the manager is also the legal representative of the enterprise: Business registration certificate.

+ In case the manager holds management positions within the company and is recognized by the company charter: Enterprise charter and appointment decision.

– Executive Director: To prove that the employee is an Executive Director, the enterprise needs to provide the following documents:

+ Certificate of registration of branch operations or Certificate of registration of representative office operations.

+ The company charter records the position of Executive Director.

– Expert: To be able to work in the position of expert, foreign workers must meet one of the following conditions:

+ Have a university degree or higher or equivalent and have at least 3 years of working experience in the specialized field of training suitable for the job position that the foreign worker is expected to work in Vietnam.

+ Have at least 5 years of experience and have a practice certificate suitable for the job position that the foreign worker is expected to work in Vietnam.

– Technical workers: Foreign workers can work in the technical position when they fall into one of the following two cases:

+ A graduation certificate in a technical field or another field with a training period of at least 01 year and a document confirming the holding of an equivalent position for 03 years or more from a foreign enterprise or organization.

+ Document confirming that the employee has held a similar position for 05 years or more at a foreign enterprise or organization.
