  • The business activities of the representative office of the Hong Kong-invested company must be consistent with Vietnam’s commitments in international treaties to which Vietnam is a member;
  • The Hong Kong-invested company wishing to establish a representative office in Vietnam within 2 years shall not be subject to the revocation of the representative office license as of the date of filing the application for a representative office establishment license;
  • The establishment of a representative office of a Hong Kong-invested company must comply with issues of security, defense, safety, social ethics, and public health.

Note: In case the representative office does not meet the time limit of the business license, or other documents, or the foreign trader is not recognized by Vietnamese law, the application for the establishment of a representative office of a Hong Kong-invested company must be approved by the Minister of the relevant management agency.

To establish a representative office of a Hong Kong-invested company in Vietnam, the following documents must be prepared:

  • Application for a license to establish a representative office;
  • Certified copy of the business license;
  • Documents equivalent to the business license (if any);

  • Copy of the ID card/passport of the head of the representative office;
